Ištrauka
II paskaita
The problem of international law – law is not law because it is not enforceable. Majority of experts disagree with that and said that it is still valuable.
Soft law – [ hard law it is like what your national law is. E.g. you kill somebody and they catch you, you have trail if you lose you go to prison. It is enforceable. Much of international law is soft law. Soft meaning it is a law but is really not .. yuo can not enforce many times. [e.g. Russia and Krymea, lets say it is illegal , what are you going to do with Russia, she have nuclear weapons – to go and say to leave it? do you have order to do that? She said NO. What you can do? It is soft law. It is law that sometimes you can not enforce. Much a human rights law is soft law.
